It seems to be a bottoms up mechanism based on competitive routes, but routes, especially U.S. domestic routes, are not permanent and are adjusted periodically. The system is presumably vulnerable to gaming by well placed DOJ insiders. DOJ does not seem to understand the overall competitive picture which should be their main concern. The American/US Air merger became necessary only because DOJ incorrectly allowed the United/Continental merger but should now be allowed in order to restore competitive balance.
